Terms of Service

These Terms govern your use of Measur (the "Service"), operated at getmeasur.com and app.getmeasur.com. By creating an account or using the Service you agree to these Terms.

Nothing in these Terms limits any non-waivable rights you have under the mandatory consumer-protection laws of your country of residence.

1. Eligibility and accounts

You must be at least 18 and using the Service for business purposes. You are responsible for your account credentials and for activity under your account. Keep your contact information current.

2. Subscriptions, trials, and billing

Paid plans (currently Starter at $49/month and Pro at $99/month) are billed monthly through Stripe. New accounts receive a 7-day free trial; you will not be charged if you cancel before the trial ends. Subscriptions renew automatically until canceled. You may cancel anytime from Settings; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law. We may change prices with at least 30 days' notice.

For consumers in the EU or UK: the trial and subscription describe digital services supplied immediately. Where a statutory withdrawal right applies, starting the trial constitutes a request for immediate performance of the digital service.

3. Your content

You retain all rights to the content you upload or create — plans, photos, receipts, estimates, proposals, client records, and learned prices. You grant Measur a limited license to host, process, and display that content solely to operate and improve the Service for you. Learned pricing data derived from your activity is private to your company.

4. AI-assisted features — important

Measur uses AI to extract scope, quantities, and prices from documents and photos, and to draft estimates, proposals, and change orders. AI output can be incomplete or wrong. All estimates, prices, quantities, proposals, and change orders are drafts for your professional review. You are solely responsible for verifying accuracy before relying on them, quoting a client, signing a contract, or purchasing materials. Measur is not a substitute for professional judgment, engineering review, or code compliance, and we make no guarantee regarding the profitability or accuracy of any estimate.

5. Live pricing data

Retail prices retrieved from third-party sources (including Home Depot listings via SerpApi) are informational snapshots that may lag, vary by store, or exclude taxes and fees. Verify pricing before purchase.

6. Acceptable use

Do not misuse the Service: no unlawful content, no infringing uploads, no attempts to breach security or access other companies' data, no reselling of the Service, no scraping, and no use of the Service to send spam. We may suspend accounts that violate these Terms.

7. Third-party services

Optional integrations (Google, QuickBooks, Stripe, and others) are governed by their own terms. Your use of Google user data through Measur is described in our Privacy Policy, which adheres to the Google API Services User Data Policy, including Limited Use.

8. Intellectual property

Measur, the Datum Rule mark, and the Service's software and design are our property. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.

9. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate accounts for material breach after notice where practicable. Upon termination you may request an export of your data within 30 days.

10. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Measur will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, cost overruns, or loss of business, arising from your use of the Service. Our total liability for any claim will not exceed the amounts you paid us in the 12 months before the claim arose.

12. Indemnity

You will indemnify Measur against claims arising from your content, your breach of these Terms, or your violation of law or third-party rights.

13. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflicts of law, except where the mandatory laws of your habitual residence provide otherwise. Disputes will be resolved in the state or federal courts located in Georgia, subject to those mandatory protections.

14. Changes

We may update these Terms; material changes will be announced in-app or by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
